Terms of Service

Last updated 10 October 2026.

1. About Motoland

Motoland is a peer-to-peer marketplace where riders buy and sell motorcycles, accessories, and gear, and take part in a community forum. Motoland is operated by Ricardo Oliveira (support@motoland.app). We provide the platform that connects buyers and sellers — we're not a party to any transaction, and we don't take possession of, inspect, or guarantee any item.

2. Eligibility & your account

You must be at least 18 years old to use Motoland. Give accurate information, keep your login credentials secure, and don't share your account. You're responsible for everything done through it. Don't impersonate anyone or create accounts to evade a suspension.

3. Listings & transactions

Every listing must be accurate, lawful to sell where you live, and for an item you own or are authorised to sell. Buyers and sellers arrange payment, delivery, and paperwork directly between themselves — Motoland never holds funds, escrows money, or processes payments. Inspect items and verify ownership before you pay.

4. Business and private sellers

When you create your account, you state whether you sell as a business (as part of a commercial activity, for example a dealership, a workshop or a shop) or as a private individual, and you can change that answer in Edit profile. Motoland shows that statement on the listing, so the buyer knows who they are dealing with. We rely on the seller's statement and don't verify it; stating a status you don't have breaks these terms. The rights that consumer-protection law gives someone buying from a business (such as the legal guarantee of conformity and, for distance sales, the right of withdrawal) apply only when the seller is a business. When you buy from a private individual those rights don't exist. The seller, never Motoland, is responsible for the contract and for performing it, and a business seller must comply with consumer law, including identifying itself and giving the information required.

5. Offers & messaging

An offer is a good-faith proposal to negotiate, not a binding contract, until both sides agree directly. Keep conversations respectful and on-topic, and don't use messaging or offers to spam, scam, or harass.

6. Paid promotions, ranking of results & subscriptions

Motoland offers optional paid visibility: the Featured boost highlights a single listing (or service) for 7 days, and Motoland Pro (a monthly or yearly subscription) highlights all your active listings and services and removes ads while it's active. Payments are processed by the app store you downloaded Motoland from; subscriptions renew automatically until you cancel them in your store account settings, and refunds follow the store's policies. Promotion doesn't guarantee a sale and doesn't exempt a listing from these terms — a listing removed for violating them isn't refunded. How we identify what is paid: a listing or service with an active promotion always carries the “Featured · Paid” label. The label applies to every active promotion, including those we give for free. Third-party advertising, shown through Google AdMob, is marked as an ad. How we rank results: in search and in lists, listings with an active promotion appear first and all the others after them. Within each group, the order you choose applies: by default, newest to oldest; you can also sort by price, lowest or highest first. A promotion comes first whichever order you choose and ends when the paid period ends (7 days for the Featured boost; for Pro, while the subscription lasts). In the services list, promoted ones come first and then the newest. On the home screen, each category shows up to 4 promoted listings first, the promotion ending latest first, and then the newest. What else counts: besides the promotion and the order you choose, search only filters (by text, category, price, year, area and country) and doesn't rank by relevance. We don't use your history or the seller's rating to rank listings. The home screen also shows listings you viewed recently (stored on your device) and accessories that fit the motorcycles in your garage.

7. Community & reviews

Forum posts, comments, and reviews must reflect your own honest experience. Don't post misleading reviews, manipulate ratings, or trade fake feedback. Be civil — no hate speech, threats, or personal attacks.

8. Who can leave a review

Any user with an account who has had a conversation or an offer with another user on Motoland can review them, whether as buyer or seller, with a rating from 1 to 5 and, if they like, a comment. Only one review can be left for each user reviewed, nobody can review themselves, and the author can edit their review. Reviews are visible to anyone, even without an account, and their average counts towards the user's rating. Motoland doesn't confirm that a purchase or sale took place between the reviewer and the person reviewed: a conversation or an offer is enough. A review therefore reflects its author's opinion and isn't proof that the deal went through. We don't check reviews before they are published; if you find a false or abusive one, write to support@motoland.app and we'll look at it.

9. Prohibited content & conduct

No stolen or misrepresented vehicles, illegal items, counterfeits, weapons, or anything unlawful to sell. No harassment, hate speech, spam, or scams, and no luring deals off-platform to defraud. Don't scrape, reverse-engineer, or interfere with the service.

10. Moderation & enforcement

We may remove content, hide or de-rank listings, limit features, or suspend and terminate accounts that break these terms — with notice where practical, and without it where needed to protect users. New listings and services are checked automatically before they are published: their text and photos go to OpenAI, our moderation provider, to detect prohibited content. If the check flags a listing or service, it stays hidden and you can ask for a person to review it in the app or by email to support@motoland.app. Content reported by several users may be hidden automatically pending review.

11. Disclaimers & liability

Motoland is provided 'as is', without warranties of any kind. We don't guarantee any listing, user, item condition, or that a deal will complete. To the fullest extent permitted by law, we're not liable for disputes between users or for indirect or consequential losses from your use of the platform.

12. Governing law & dispute resolution

These terms are governed by Portuguese law. If you are a consumer, this doesn't take away the protection that the mandatory provisions of the law of the country where you habitually reside give you, and you can go to the competent courts under the rules the law provides for consumers. If you have a dispute with us about the paid services we provide (the Featured boost and Motoland Pro), you can turn to an alternative dispute resolution body for consumer disputes, such as CNIACC — Centro Nacional de Informação e Arbitragem de Conflitos de Consumo (www.cniacc.pt); more bodies are listed at www.consumidor.gov.pt. You can also file a complaint in the Electronic Complaints Book (Livro de Reclamações Eletrónico, www.livroreclamacoes.pt). Before that, write to us at support@motoland.app: we always try to sort it out.

13. Changes to these terms

We may update these terms as the product evolves. We'll revise the date above and, for material changes, ask you to accept again in the app. Continuing to use Motoland after an update means you accept the revised terms.

14. Contact
